19 September 2014 The arbitration court made a decision that it should be necessary to take the construction permit from the developer of one of the most famous long-term uncompleted construction projects in the center of Yekaterinburg.
An unscrupulous developer SPEC LLC 5 years ago during the construction of a complex of residential and non-residential premises in the city of Yekaterinburg (Khokhryakova Str., 72) put a residential part in operation, and registered it as a non-residential facility under construction, and tried to take from the investors for himself, and then he went into bankruptcy. As a result, for three years of litigation, the investors have recognized their rights to premises in the facility under construction, and the city administration in the summer of 2014 refused SPEC LLC to extend the construction permit (although extended three times prior to it). The refusal was appealed to the administration of the court. The TSZH (Condominium Partnership) “Khokhryakova, 72” was involved in the case on the side of the administration, which was represented by the Director of the Law Firm “KONUS” Aleksei Silivanov. As a result, the main struggle broke out between the TSZH (Condominium Partnership) and SPEC LLC, but the final decision to reject to sustain the claims of ex-builder in dispute made a dramatic dot.
